These terms apply to Chillybin Website Care plans and time blocks. Your plan is provided by the Chillybin company named on your invoice:
- Chillybin Pte. Ltd. (UEN 200910914R) for clients of our Singapore office; or
- Chillybin Studio Pty Ltd (ABN 86 661 069 950) for clients of our Brisbane office.
“We” and “us” mean that company. Your plan, its price and its included hours are as shown in your proposal or sign-up. If those and these terms disagree, the proposal or sign-up wins.
1. What’s included
Every plan includes WordPress core, theme and plugin updates, daily offsite backups, uptime and security monitoring, and a monthly report. Plans with support hours also include the hours and response times listed for that plan. Routine maintenance never comes out of your support hours.
Small fixes that take under 20 minutes are covered on every plan. Larger tasks come from your included support hours or a time block, or we quote them first.
2. Access
To look after your site, you authorise us to access your WordPress admin, hosting account and files, and to install, update or remove plugins needed for maintenance and security. If your host limits that access, we’ll tell you what we can’t cover.
3. Support hours and time blocks
Included support hours renew each month. They roll over only on plans that say so. If a job will go beyond your remaining hours, we’ll tell you before we start and you can approve the extra time, buy a time block or upgrade your plan.
Time block hours don’t expire while you remain a client.
4. Fees and payment
Plans are billed monthly in advance to the payment method you give us, in the currency shown on your proposal or sign-up. Prices exclude GST unless stated. We’ll give you at least 30 days’ written notice of any price change, and you can cancel before it takes effect.
If a payment fails and isn’t fixed within 14 days of our notice, we may pause the plan until it is.
5. Cancelling
You can cancel any time after your first month by emailing hello@chillybin.co. Cancellation takes effect at the end of the billing period you’ve paid for, and we’ll hand over access and your latest backup.
Fees for a month that has started aren’t refunded, and time blocks aren’t refunded once work on them has started, unless the law requires otherwise.
6. Changes made by others
If someone outside our team (including a third-party developer) changes the site and breaks its design or functions, repairs come from your support hours or are quoted at our standard hourly rate.
7. Content
You’re responsible for the content of your site. We may decline to work on content that is unlawful, offensive or malicious.
8. Limits
We take care to keep your site secure, backed up and running, but no site can be guaranteed free of downtime, data loss or security incidents, and outages at your host or other third parties are outside our control. If something goes wrong, we’ll restore from backup and work to fix it.
To the extent the law allows, our total liability under your plan is limited to the fees you paid in the 3 months before the claim, and neither party is liable for indirect or consequential loss, including lost revenue or lost data.
For Australian clients: our services come with guarantees that can’t be excluded under the Australian Consumer Law, and nothing in these terms excludes, restricts or changes them.
9. Changes to these terms
We’ll give you at least 30 days’ written notice of any change to these terms. If you don’t agree, you can cancel before the change takes effect.
10. Governing law
For Chillybin Pte. Ltd. plans, Singapore law applies and the courts of Singapore have exclusive jurisdiction. For Chillybin Studio Pty Ltd plans, Queensland law applies and the courts of Queensland have non-exclusive jurisdiction.
